Full Terms and Conditions

 

1.      This Promotion is only open residents of Great Britain (England, Scotland and Wales) aged 18 or over who are members and employee members of Co-operative Group Limited who make a purchase of a participating product and swipe their membership card in a Co-operative Group Food store during the Promotion Period (Qualifying Purchase). Temporary membership card holders are automatically excluded from this promotion. Any employees of the Promoter, Co-operative Group Limited (or any of its group undertakings and its agencies) or any other person who are directly connected with the creation and administration of this Promotion are excluded from entering this Promotion.

 

2.      Maximum 1 entry per swipe.

 

3.      Promotion Period: Enter between 00.01 BST on the 11th September 2019 and 23.59 BST on the 1st October 2019 inclusive.

6.      The Prize: There are 5 Prizes available to be won. 5 winners will each win a pair of tickets to an exclusive post release screening of Downton Abbey in London.

 

7.      Further Prize Details and Conditions:

 

        i.            For the removal of doubt, winners must be over 18, and any guest under 18 needs to be accompanied by at least 1 adult.  

       ii.             The date of the screening is 1st November 2019. All winners are responsible for any extra charges incurred whilst redeeming the tickets and neither travel nor spending money is included.

     iii.            Attendance at the screening is subject to Universal’s screening security policy and Universal reserves the right to refuse entry and/or to remove anyone who does not comply with this policy.

     iv.            Filming is strictly prohibited in the Universal Screening Rooms and no recording devices are permitted to be used during the Screening.

       v.            Accommodation will be provided for 1 night to those who live more than 50 miles away from the venue. In such an event, the Promoter will pay the cost of the standard room plus related room taxes; however, the winner is solely responsible for any additional charges incurred during their stay, including, without limitation, costs of meals, drinks, additional nights and services together with related taxes.  A valid credit or debit card will be required to check in to your room and will be used to guarantee any incidentals such as in-room calls or services.

  1. For the avoidance of doubt, the prize does not include travel/transportation, accommodation, food, beverages, souvenirs, gratuities, car parking charges, excess baggage, additional excursions and attractions or any other costs of a personal nature (including spending money) that are not explicitly set out in these terms and conditions and neither the Promoter nor any provider of any part of the Prize will be responsible for any such costs.
  2. The prize must be taken at the stated times; no alternatives are available. If the winner cannot attend the screening, no alternative tickets will be issued and for the avoidance of doubt, no compensation and/or refund will be provided;

 viii.            The winners must inform the Promoter of any wheelchair or any similar access needs.

     ix.            Winners are responsible for the behaviour of themselves and their guest whilst taking the Prize. The Promoter reserves the right in its absolute discretion to exclude a winner and/or guest from participation in any aspect of the Prize if any party fails to comply with the directions of the Promoter or any companies associated with the Prize, or if a winner and/or guest act in a manner that is dangerous to themselves or to the public or is, in the opinion of the Promoter, anti-social in any manner or which causes a disturbance or nuisance to others.

       x.            You and your guest must abide by any relevant terms and conditions which form part of your prize. Whilst at the event/venue, you must not: be drunk, intoxicated, under the influence of drugs, be abusive, threatening, make or incite racial abuse, chant, use offensive language, make obscene gestures, throw items, behave anti-socially, carry laser pens, bring animals (except guide dogs), carry offensive weapons or illegal substances,, climb any structure, make excessive noise, offer any item for sale, damage the venue or smoke. You consent to be filmed and/or photographed at the event/venue. We are not liable for loss, injury or damage to you unless we have breached a legal duty of care owed to you.  It is your responsibility to ensure that you take care when moving around the event/venue.  The Promoter is not liable for damage or loss to your property unless this occurred due to the Promoter’s wilful misconduct. Failure to comply with these Terms and Conditions may result in refused entry, or the ticket holders being required to leave the event/venue.

 

8.      Winner Selection: 5 winners will be randomly selected from all valid entries received during the Promotion Period. The prize draw will be conducted under independent supervision within 3 days of the end of the Promotion Period.

 

9.      Winner Notification: The winners will be contacted by the details registered to their Co-op Membership Record within 3 working days of Winner Selection and will be required to respond to confirm eligibility and acceptance of the Prize, within 7 days of initial contact. In the event that a winner does not respond to the initial contact within 7 days, the Promoter reserves the right to disqualify that winner. If a winner is disqualified, the Promoter reserves the right to award the prize to a reserve selected in the same manner. Reserve winners may have less time to respond. Neither the Promoter nor Co-operative Group limited will be liable for any incorrect details held on the winners’ Co-op Membership Record.

 

10.  The Promoter may request that the winners participate in reasonable publicity related to this Promotion.

 

11.  The Prize is not transferable or exchangeable and cannot be redeemed for monetary value or for any other form of compensation. If for any reason the Prize is not available, the Promoter will substitute another prize for it of equal or higher value.

 

12.  If for any reason any aspect of this Promotion is not capable of running as planned, including where there is infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, dishonesty, technical failures or any cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter reserves the right to disqualify any individual who tampers with the entry process or does not comply with these Terms & Conditions and may cancel, terminate, modify or suspend the Promotion or invalidate any affected entries.

 

13.  The Promoter and any associated agencies and companies will not be liable for any loss (including indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this Promotion or accepting or using the Prize, except for any liability which cannot be excluded by law.  Nothing will exclude our liability for death or personal injury as a result of our negligence.

 

14.  Any entry must be made directly by the person entering the Promotion. Bulk entries from trade, consumer groups or third parties will not be accepted. Incomplete or illegible entries and entries which do not satisfy the requirements of these Terms & Conditions in full will be disqualified and will not be counted.

 

15.  If an act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these Terms and Conditions the Promoter will not be liable for any failure to perform or delay in performing its obligations.

 

16.  The winners agree to allow the Promoter to use their surname and county of residence to announce the winners of the Promotion. The Promoter reserves the right to publish the surname and county of residence of the winners. The winners may object to their surname or county of residence being published or request for the amount of information being published to be reduced by contacting customerservices-uk@lindt.com.

 

17.  Subject to the consent of the winners, the surname and county of residence of the winners can be obtained by emailing customerservices-uk@lindt.com for 4 weeks following the close of the Promotion.

 

18.  Any personal data which relates to entrants will only be used for this Promotion by the Promoter and/or by any agent appointed by it to assist with running of the Promotion on behalf of the Promoter unless the Promoter has the entrants’ positive consent. Entrants’ personal data will be handled in accordance with the Promoter’s privacy policy, available at: lindt.co.uk/help/privacy-notice/.

 

19.  If any provisions of these Terms & Conditions are judged to be invalid, illegal or unenforceable, this shall not affect or impact the continuation in full force and effect the remainder of the provisions.

 

20.  By entering this Promotion, entrants agree to be bound by these Terms & Conditions.

 

21.  In the event of a discrepancy between these Terms & Conditions and the details in any promotional material, the details in the Terms & Conditions shall prevail.

 

22.  These Terms & Conditions are governed by English law and their interpretation and application shall be subject to the exclusive jurisdiction of the courts of England and Wales.

1. This prize draw is open to UK residents only ({England, Scotland, Northern Ireland & Wales}) aged 18 and over, who hold a Nectar Card, with the exception of employees of Lindt or anyone else associated with the administration of this promotion.

 

2. Purchase any of the following products: Any Lindor chocolate truffles 200g or Lindor treat bar 38g product and use your Nectar Card in the same transaction for automatic entry into the draw: {Lindt Downton Abbey}. The promotion opens on 00:01 GMT 28/08/2019 and closes at 23:59 GMT on 11/09/2019 for receipt of all entries. All online orders must be delivered by 23:59 on 11/09/2019 to qualify.

3. No purchase necessary in NI only; NI shoppers may also enter the prize draw by calling the Call Centre on 0344 811 0811, quoting your Nectar card number and the code: {LindtDowntonAbbey2019}

4. Entries are restricted to one per transaction for the duration of the promotion. No entries from agents, third parties or organised groups will be accepted. No bulk entries.

 

5. Prize: A Luxury Estate Stay for two with Downton Abbey.

Prize package includes the following:

i.                    Train Travel: Return train travel within mainland UK to Leeds.

6. Additional Terms and conditions:

 

a.      Train travel available from mainland UK rail stations only;

b.      A valid credit or debit card will be required for security deposit purposes when checking into accommodation;

c.        Accommodation is based on two adults sharing one double/twin room;

d.      Accommodation will be selected by prize provider at their sole discretion;

e.      Prizes are non-transferable and non-refundable; No cash alternative is available;

f.        Prize is subject to availability; Prize cannot be taken from 21st December 2019– 2nd January 2020 (Christmas and New Year), over UK bank holidays, or over Easter Sunday;

g.      Prize is valid for 12 months from the date of notification of winning, and travel must be booked and completed within that time frame;

h.      Winners must contact prize provider with three preferred travel dates no later than six weeks prior to departure;

i.        Stay must include a Saturday night in the hotel;

j.        All elements of the prize must be taken at the same time;

k.       Once booked, the prize cannot be altered or amended;

l.        At least one traveller must be aged 18 or over; Where any travellers are aged under 18, they must have prior parental or guardian permission;

m.    the prize excludes transfers from winner’s home to the local station;

7. The prize will be delivered to the winner within 28 days of being notified of their prize.

9. The winners will be drawn at random during week commencing the 25th of September 2019 under independent supervision.

 

11. The Promoter’s decision is final and binding in all matters and no correspondence will be entered into.

 

12. No Nectar Card primary holder may win more than one prize.

 

13. Winners will be notified by telephone and will be advised to contact a fulfilment agency for details on how to claim the prize. 14. The Promoter is not responsible or liable for:

These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry/claim instructions are deemed to form part of the terms and conditions and by participating all entrants will be deemed to have accepted and be bound by the terms and conditions. •          Meals, drinks, excursions, attractions, treatments, visas, personal expenses and anything not expressly stated in the prize package are excluded.

•          If any element is unavailable, experiences and items of a similar nature and value may be offered.

•          If winner elects to partake in any or all portions of his/her prize with no guest, the prize will be awarded to winner and any remainder of the Prize will be forfeited and shall not be subject to further or alternative compensation.

•          For the afternoon tea, this is provided to the set menu value of £85 per person plus service charge; alcohol will only be served to guests who are aged 18 or over and proof of age may be required; a smart/casual dress code applies.

Runner Up Prize Terms and Conditions

·         The prize voucher is for up to two people. The prize voucher will be valid for 24 months from the time of receipt.

·         Dates will vary according to the experience chosen, and venues are subject to availability at the time of booking.

·         All winners are responsible for any extra charges incurred whilst redeeming the vouchers and neither travel, spending money, or any other costs of a personal nature will be included.

·         The winners must inform the Promoter of any wheelchair or any similar access needs.

 

Other:

Exclusions: Anything not specified in these terms and conditions as being included in the prize package is excluded.

 

Universal reserves the right to substitute any prize with a prize of equivalent value and other than for death or personal injury resulting from Element's negligence and so far as permitted by law, Universal hereby excludes all liability for any loss, damage, cost and expense, whether direct or indirect, howsoever caused in connection with the Competition or any aspect of the Prize.

 

 

 

12.  Winner Selection: The winners will be drawn using a random number generator within 14 days of the closing date.

13.  Winner Notification: Winners will be notified by text within 14 days of the closing date. It is the responsibility of the participant to ensure that they respond to the winner notification, either by calling the Freephone number or emailing the address provided at the point of notification. Winners who do not respond within the initial 7 days, will be telephoned and given a further 7 days to respond. If contact cannot be made, or the prize is not claimed, within 14 days of the initial prize notification date an alternative winner will be drawn. The Promoter cannot be held responsible for winners failing to supply accurate information which affects prize acceptance or delivery of their prize.

 

14.  General: The entry instructions form part of the terms. By entering, you agree to accept and be bound by the terms.

 

15.  The Promoter’s decision is final and binding. No correspondence will be entered into.

 

16.  The prize must be accepted as offered by the named winners. There is no cash or alternative prizes, in whole or part. The prize is not transferable. Sale of the prize for profit is prohibited and may constitute fraud.

 

17.  The Supplier reserves the right to provide alternative prizes of equal or greater value should circumstances outside its control make this necessary

 

We reserve the right to verify winners and ask for proof of identity, age and address and to withdraw prize entitlement where there are reasonable grounds to believe there has been a breach of these terms and conditions.

18.  The Promoter reserves the right, at its sole discretion, to eliminate or disqualify any entries or entrants that it regards as being in breach of these terms and conditions or the spirit of the Promotion. Those who try and circumvent the entry process and/or entry instructions by any method, will be disqualified and any prize award will be void.

 

19.  Entry into the Promotion is at the entrant's sole risk. To the extent permitted by law, the Promoter does not accept any responsibility for any damage, loss, liabilities, injury, costs, expenses or claims (whether in contract, tort or otherwise) suffered by entrants or any third parties arising out of or in connection with the Promotion and/or accepting a prize. The Promoter further disclaims liability for any injury or damage to entrants or any other person relating to or resulting from participation with this Promotion save that nothing in these terms and conditions shall act to limit or exclude the Promoter's liability resulting from its negligence or fraud.

 

20.  The Promoter accepts no responsibility for system errors or other issues that may result in disruption to, lost, delayed or not received entries, winner notifications or prizes. The Promoter or its agencies will not be responsible for the non-inclusion of entries as a result of technical failures or otherwise, including any such failure which is within the control of The Promoter or its agencies.

 

21.  The Promoter and the Supplier reserve the right to cancel, amend, withdraw, terminate or temporarily suspend this promotion in the event of any unforeseen circumstances or technical reason outside its reasonable control, with no liability to any entrants or third parties but will use all reasonable endeavours to avoid consumer disappointment. The Supplier bears sole responsibility for supply of the prize and Tesco cannot be held responsible for any claims relating to the prizes.

 

22.  The application and interpretation of these terms and conditions shall be governed by the law of England and the courts of England and Wales shall have exclusive jurisdiction in relation to any dispute concerning them.

 

23.  Your data will be passed onto a third-party fulfilment service provider for the purposes of administering the prize and with Dunnhumby Limited for quantitative research purposes only. The surname and county of the winners will be made available to anyone who requests them by emailing Lindor@tescoprizes.com within 3 months of the closing date. Participants may request their name and county is not published in the event they win by emailing LindorOptOut@tescoprizes.com before the closing date. Your details will not be passed onto any third party for any other purpose without prior consent. This data will be kept secure and in accordance with the requirements of the Data Protection Act. 1.     This Promotion is open to residents of the United Kingdom aged 18 or over, excluding employees of the Promoter and anyone professionally associated with this Promotion.

 

2.     No purchase necessary; however, Internet access and a public Facebook, Instagram or Twitter account are required.

 

3.     Entrants must ensure that their Facebook, Instagram or Twitter account is set to “Public” for the duration of the Promotion Period and remains so for 10 days following the end of the Promotion Period. Only entries made from a public account will be valid.

 

4.     Promotion Period: Enter between 00.01 BST on the 2nd September 2019 and 23.59 BST on the 22nd September 2019 inclusive.

7.     The Prize: 1 winner will win a 2 night stay for 2 people in a luxury room at The Alexander House & Utopia Spa, including £35 per person per night dinner credit, full English breakfast per person per night and a Lindor chocolate hamper worth £100 (subject to availability).

 

8.     Further Prize Details and Conditions:

a.    For the avoidance of doubt, the prizes do not include travel/transportation, accommodation, food, beverages, souvenirs, gratuities, car parking charges, additional excursions and attractions or any other costs of a personal nature (including spending money) that are not explicitly set out in these Terms and Conditions and neither the Promoter nor any provider of any part of the Prizes will be responsible for any such costs.

b.    Accommodation is subject to availability at the time of booking. Alternatives may be offered depending on availability.

c.    The winners must inform the Promoter of any wheelchair or any similar access needs.

d.    The Prizes must be booked and taken by 30th April 2020 (subject to availability) but excludes Christmas and New Year (20th December 2019 – 1st January 2020), and Bank Holiday periods in the UK.      

e.    The winners are solely responsible for any additional charges incurred at the hotel during their stay, including, without limitation, costs of meals, drinks, additional nights and services together with related taxes.

f.      A valid credit or debit card will be required to check in to your room and will be used to guarantee any incidentals such as in-room calls or services.

 

 

9.     Winner Selection: 1 winner will be randomly selected from all valid entries received during the Promotion Period. The prize draw will be conducted by PromoVeritas, an independent promotional verification service, within 10 working days of the end of the Promotion Period.

 

10.  Winner Notification: The winner will be contacted via a direct message to the social media account provided on entry within 5 working days of Winner Selection and will be required to respond to confirm eligibility and acceptance of the Prize, within 14 days of initial contact. In the event that a winner does not respond to the initial contact within 14 days, the Promoter reserves the right to disqualify the winner. If the winner is disqualified, the Promoter reserves the right to award the prize to a reserve selected in the same manner. Reserve winners may have less time to respond.

 

11.  Prize Acceptance: The winner will be notified within 28 days of acceptance of the Prize to arrange fulfilment of the Prize.

 

12.  Moderation: The Promoter reserves the right to reject entries which, in the reasonable opinion of the Promoter:

a.    are in breach of the Terms and Conditions

b.    contain any content that is likely to be considered offensive by the Promoter or could reflect negatively the name, reputation, or goodwill of the Promoter or any brand partner, or which is otherwise unsuitable for publication;

c.    defames, misrepresents, or insult other people or companies, including, but not limited to the Promoter (including its partners);

d.    promotes any political agenda.

 

13.  The winner agrees to allow the Promoter to use their surname and county of residence to announce the winner of the Promotion. The surname and county of residence of the winner will be made available by sending an email titled “Lindt Social Holiday Aug 2019 WL” to Privacy.gbr@lindt.com one month after the close of the Promotion, for a period of 8 weeks. The winner may object to their surname or county of residence being published or request for the amount of information being published to be reduced during winner notification.   

 

14.  The Prize is not transferable or exchangeable and cannot be redeemed for monetary value or for any other form of compensation. If for any reason any element of the Prize is not available, the Promoter reserves the right, at its sole discretion to substitute another prize for it, of equal or greater value.

15. In the event that the Promotion is not capable of running as planned for reasons including but not limited to tampering, unauthorised intervention, fraud, dishonesty, technical failures,  or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter reserves the right to disqualify any individual who tampers with the entry process or does not comply with these Terms & Conditions and to cancel, modify or suspend the Promotion or invalidate any affected entries.

16.  No responsibility can be taken for entries which are lost, delayed, corrupted, damaged, misdirected or incomplete or which cannot be delivered for any technical, delivery or other reason. You understand that you are providing your information to the Promoter and not to Facebook, Instagram, or Twitter and that Facebook, Instagram, or Twitter has no liability for any element of this Promotion.

 

18.  The Promoter together with any associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this Promotion or accepting or using a Prize, except for any liability which cannot be excluded by law.  Nothing will exclude the Promotor’s liability for death or personal injury as a result of its negligence.

 

19.  An entry must be made directly by the individual entering the Promotion. Bulk entries from trade, consumer groups or third parties will not be accepted. Incomplete or illegible entries and entries submitted by macros or other automated means together with entries which do not satisfy the requirements of these Terms & Conditions in full will be disqualified and will be not be counted. If it becomes apparent that a participant is using a computer(s) to circumvent this condition by, for example, the use of ‘script’, ‘brute force’, masking their identity by manipulating IP addresses, using identities other than their own or any other automated means in order to increase that participant’s entries into the Promotion in a way that is not consistent with the rules of the Promotion, that participant’s entries will be disqualified and any prize awarded will be void.

 

20.  Should an act, omission, event or circumstance occur which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these Terms & Conditions the Promoter will not be liable for any failure to perform or delay in performing its obligations.

 

21.  The Promoter may refuse to award a Prize or seek its recovery, in the event of any entrant’s fraud, dishonesty, breach or non-entitlement under these Terms & Conditions.

 

22.  Any and all personal data supplied for the running of this Promotion will be used solely for the purpose of this Promotion by the Promoter and/or by any agent appointed by it to assist with running the Promotion on behalf of the Promoter and will not be disclosed to a third party for any other purpose unless the participants’ positive consent has been obtained. 23.  If any provisions of these Terms & Conditions are judged to be invalid, illegal or unenforceable, this will not affect or impact the continuation in full force and effect the remainder of the provisions.
