MyLindt Rewards: Terms & Conditions

1. Scope and purpose

1.1 The following terms and conditions ("Terms") apply to the MyLindt Rewards ("Loyalty Programme") operated by Lindt & Sprüngli (UK) Limited, contact form available at ("Lindt", "we", "our", "us") in the UK. The Loyalty Programme is for consumers only, i.e. natural persons who enter into a legal transaction for purposes that are predominantly outside of their trade, business or profession.

1.2 "You" or "your" within the meaning of these Terms refers to all users that register for the Loyalty Programme on ("Website") or in person in a Lindt Chocolate Shop participating in the Loyalty Programme ("Lindt Chocolate Shop”); for further information please refer to our Website). The Lindt Chocolate Shop which is not currently participating in the Loyalty Programme is the Lindt Chocolate Shop Kildare Village, Unit 59, Nurney Road, Kildare, Ireland, R51 E168.

1.3 The Loyalty Programme entitles you to receive certain benefits and can grant you certain vouchers.

2. Registration and creation of a Customer Account

2.1 You are eligible for participation in the Loyalty Programme if you are at least 18 years of age. Participation in the Loyalty Programme does not require you to make any purchases and is free of charge.

2.2 You can register for the Loyalty Programme online or in a Lindt Chocolate Shop by filling out the required fields (title, first name, last name, birthday, email address, password) ("Registration Data") in the registration form and clicking on the "Create an account" button. The Registration Data provided by you during the registration process must be correct. Before submitting the registration form, you may identify and correct input errors, if any.

After submitting your registration, you will receive a confirmation of the receipt of the request for registration via email. Lindt can refuse to accept the registration without giving any reasons.

2.3 By registering, you create a customer account ("Customer Account") and enter into a contract with Lindt for membership to the Loyalty Programme subject to these Terms (the "Agreement"). The current version of the Terms will be available on the Website.

2.4 You must securely store the Registration Data for your Customer Account, in particular the password, away from third parties. Disclosing your Registration Data to third parties is not permitted.

2.5 You must inform Lindt immediately in case of a suspected possible misuse of your Registration Data. In such case, Lindt is entitled to suspend access to your Customer Account.

3. Loyalty Programme Membership Card

When you register for the Loyalty Programme you will be provided with a digital membership card ("Membership Card"). The Membership Card has a barcode that can be scanned at the Lindt Chocolate Shop for identification, in addition to your MyLindt card number. The Membership Card can be printed, screenshotted or added to Apple Wallet or Google Wallet. Your Membership Card, Customer Account, vouchers, in whatever form, are issued by and remain the property of Lindt, which may at any time, terminate the Loyalty Programme or amend the Terms.

4. Vouchers and programme benefits

4.1 Once registered for the Loyalty Programme, you will benefit from:

• A voucher that you can redeem after your registration ("Welcome Voucher").

• Access to one or more products every month which will be discounted exclusively for members of the Loyalty Programme.

• Personalised discounts (if you have consented to advertising and marketing).

• You will receive a defined number of discount vouchers based on your spend for the respective calendar year (further details can be found on our website, The amount of your spending will be reset to GBP 0 at the beginning of each new calendar year. The first reset of your spending will take place on December 31 of the calendar year in which you register. Shipping costs and gift card spend will not count when calculating your annual spend.

• A reward for your birthday provided that you are registered with the Loyalty Programme ("Birthday Surprise").

• Access to exclusive promotions, services and events.

4.2 If making a purchase online, you must be logged into your Customer Account so that any spending is credited to your Customer Account and you receive the vouchers and programme benefits you are entitled to. Offline spend (purchases in the Lindt Chocolate Shop) is also credited to your Customer Account if the Membership Card was recorded at the time of purchase.

4.3 You can redeem rewards at the Lindt online shop or at any of the Lindt Chocolate Shop in the UK by using a voucher code.

4.4 Rewards and vouchers cannot be transferred to any third party and cannot be redeemed in cash.

5. Your legal rights

6. Our responsibility for loss or damage suffered by you

6.1 We are responsible to you for foreseeable loss and damage caused by us. If we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this Agreement or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen, for example, if you discussed it with us during the sales process.

6.2 We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; for fraud or fraudulent misrepresentation; for breach of your legal rights in relation to the products.

6.3 We are not liable for business losses. We only provide the Loyalty Programme to you for domestic and private use. If you use the Loyalty Programme for any commercial, business or re-sale purpose we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

7. Term and Termination

7.1 The Agreement continues until you or Lindt terminate it.

7.2 The Agreement may be terminated by you without cause at any time. If you ask to delete your Customer Account, this will be deemed a termination. In case of a termination, your registration will be deleted and you will lose the right to access your Customer Account and its content. If Lindt terminates the Agreement, you will be provided with three (3) months' notice before your Customer Account is deleted, in which three (3)-month period you must redeem any unused vouchers. If the Agreement is terminated by either you or Lindt, we will provide you with an opportunity to export the data from your Customer Account. If you terminate the Agreement, and you will have [three (3)] months to redeem any unused vouchers after we receive your termination notice (see Section 7.4 below).

7.3 The right to terminate for cause by either you or Lindt remains unaffected.

7.4 If the Agreement is terminated by you, notice of termination must be given in writing, e.g., by submitting your inquiry via our online contact us form: Lindt may also give notice of termination when you log into your Customer Account by means of a notice displayed on the Website.

10. Changes to these Terms

10.1 Lindt reserves the right to make reasonable changes to the Terms. In particular, Lindt occasionally makes legally required updates, which are changes that keep our Loyalty Programme compliant with applicable law. We also may make minor technical adjustments and improvements to our Loyalty Programme, for example for security reasons or to ensure that our Loyalty Programme meets expected quality standards (e.g. those described in Section 5).

10.2 You will be notified by us about any changes to these Terms. If you do not reject those changes in writing (e.g. by email) within 4 weeks after receipt of the notification, the changes are deemed to be agreed. We will expressly notify you about the right to reject and the consequences of being silent.

10.3 If you reject the changes, we reserve the right to terminate the Agreement in accordance with Section 7 above.

11. Choice of law and jurisdiction

11.1 These Terms are governed by English law and wherever you live you can bring claims against us in the English courts. If you live in Wales, Scotland or Northern Ireland, you can also bring claims against us in the courts of the country you live in. We can claim against you in the courts of the country you live in.

12. Miscellaneous

12.1 Any conflicting or supplementary terms and conditions shall only apply to your participation in the Loyalty Programme if explicitly accepted by Lindt in writing.

This Agreement is between you and us. Nobody else can enforce it and neither of us will need to ask anybody else to agree to ending or changing it.

12.2 Should any of the provisions of these Terms be or become invalid in whole or in part, this shall not affect the remainder of the Agreement concluded with you.
